1. Acceptance of Terms

By accessing or using Scholar Africa at https://scholar.africa ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

These Terms constitute a binding agreement between you and Suryateja Manchikatla (a natural person and the individual operator of Scholar Africa, currently resident in the United Republic of Tanzania), referred to in these Terms as "we", "us", or "our". Scholar Africa is operated as an independent project under the working name "Vyoma AI Studios" (an unincorporated personal project, not a registered company).

Sponsorship disclosure: Scholar Africa receives financial support from Karibu Camps & Lodges and Spanishtiles & Sanitary Ware. These sponsors are not parties to these Terms, have no contractual relationship with you as a user, and have no role in operating the platform. They are not joint controllers of user data and are not liable for any aspect of platform operation.

If you are using the Platform on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Service Description

Scholar Africa is a free scholarship discovery and matching platform for African students. We provide:

Scholar Africa is an aggregation and discovery platform. We do not administer, fund, or endorse any scholarship listed on the Platform. All applications are submitted directly to the scholarship provider.

3. Eligibility & Account

To use Scholar Africa, you must be at least 16 years old. Users under 18 should have parental or guardian awareness of their use of the Platform.

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorised access to your account.

You may not create accounts for others without their consent or create multiple accounts to circumvent restrictions.

5. Scholarship Data Accuracy Disclaimer

Important: Scholarship information on Scholar Africa is aggregated from public sources and scholarship providers. We do not guarantee the accuracy, completeness, currency, or availability of any scholarship listed.

Specifically:

You are solely responsible for verifying all scholarship information directly with the scholarship provider and for submitting accurate, complete applications. Scholar Africa is a discovery tool only.

6. No Warranty

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

Some jurisdictions do not allow exclusion of implied warranties. To the extent prohibited by law, this exclusion may not apply to you.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SCHOLAR AFRICA AND VYOMA AI STUDIOS SHALL NOT BE LIABLE FOR:

IN ANY EVENT, OUR TOTAL AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ZAR 500. AS THE PLATFORM IS FREE, THIS WILL GENERALLY BE ZAR 0.

Some African jurisdictions (including South Africa's Consumer Protection Act 68 of 2008) provide minimum consumer protections that cannot be excluded. These Terms do not limit rights you have under applicable consumer protection law.

8. Intellectual Property

The Scholar Africa platform, its design, matching algorithms, and original content are owned by Suryateja Manchikatla (operator) and protected by copyright and other applicable intellectual property laws. Sponsor brands (Karibu Camps & Lodges, Spanishtiles & Sanitary Ware) and their marks remain the property of those respective entities and are not transferred to Scholar Africa.

Scholarship data (names, descriptions, criteria) belongs to the respective scholarship providers. Scholar Africa displays this data under fair use / informational purposes.

You retain ownership of your profile data. By using the Platform, you grant Scholar Africa a limited, non-exclusive, royalty-free licence to process your profile data for the purpose of providing scholarship matching services.

9. Privacy

Your use of Scholar Africa is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the data processing described in the Privacy Policy.

10. Termination

You may delete your account at any time via your account settings or by submitting a deletion request through our Data Request Portal.

We may suspend or terminate your access at any time if:

On termination, your profile data will be anonymised as described in the Privacy Policy. Your scholarship application records will be retained in anonymised form for audit purposes.

11. Governing Law & Disputes

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict-of-law principles.

The primary governing law of these Terms is the law of the United Republic of Tanzania, because the operator (Suryateja Manchikatla) is resident in Tanzania at the time of writing. Users in the EU/EEA retain rights under applicable EU consumer-protection law. Users in South Africa retain rights under POPIA and the Consumer Protection Act 68 of 2008. Users in Nigeria retain rights under the Nigeria Data Protection Act. Users elsewhere retain mandatory rights under their local consumer-protection law that cannot be excluded by contract.

We encourage you to contact us first to resolve any dispute informally. If a dispute cannot be resolved informally within 30 days, it shall be referred to the courts of the United Republic of Tanzania with jurisdiction over such matters, unless applicable consumer-protection law in your jurisdiction grants you the right to bring proceedings in your local courts.

Nothing in these Terms prevents you from lodging a complaint with the South African Information Regulator or other applicable regulatory body.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated by:

Your continued use of Scholar Africa after the effective date of changes constitutes acceptance of the revised Terms. If you do not agree with changes, you should stop using the Platform and may request account deletion.
